PHILADELPHIA—Roger Eichenholtz, 70, of Westchester County, New York, was charged today by indictment with one count of communicating threats, announced United States Attorney Zane David Memeger. After losing civil litigation over a business, Eichenholtz sent a numbering of harassing e-mails to his opponents threatening further litigation. On September 24, 2013, Eichenholtz sent another e-mail threatening civil and criminal litigation. He concluded the e-mail with the following:
PLAN B- if for some unforeseen miracle, you escape justice, I have access to a “Side Bolt 45.cal with 6 silver bullets that have your name on them.”
If convicted, the defendant faces a maximum possible sentence of five years of imprisonment, three years of supervised release, a $250,000 fine, and a $100 special assessment.
The case was investigated by Federal Bureau of Investigation and is being prosecuted by Assistant United States Attorney Michael L. Levy.
